Copyright claim on this site!

Postby admin » Fri Mar 14, 2014 10:12 am

Well it had to happen. Everard has found this site and has now written to my host provider claiming no less than 100 copyright infringements against this site. Wow! Eh Chris... WOW!

So to avoid issues - because we dont really care about you seeing his DVD covers and bits of his website we have decided to anonymise these pictures so he cannot complain. The resultant blurring you will see should give you enough idea fo what was there... and there will usually be a link next to the blurred pics so that you can go and see the real thing for yourself.

This isnt the end of this - by a long shot. Still to smooth things over because god forbid we might show a static picture of a DVD cover of website and this may lose him business. No infact we are quite sure that is the content of the text written in the articles alongside these now blurred images which will make people form their opinions and do further research on Mr Everard. So balls yet again back in your court Mr Everard. Seeing as you are now watching this site, do you care to refute any of its details - rather than just trying and failing in getting it shut down?

Here is an email I have writted to Mr Everard, and I will offer his reply on this forum.

Dear Mr Everard

Further to discussions with my provider who have asked me to remove copyright materials from a website and they have copied me your email to them.

I have pointed out to them with relevant supporting information that neither your name or its variants or enigmatv or its variants is trademarked according to the UKs Intellectual Property Office. Unless Everard can provide me with an index ref number for his Trademark application I will have to assume that this was a mistake on his part and you do not have a trademark of any type for any of your interests.

Thus you cannot claim trademark violation of a site name I legitimately own. I think my providers will be curious why you said you had a trademark when a simple search showed you do not. Still that is another matter.

I have been made aware that you have sent my provider a PDF with 100 items you wish to see removed. Please forward this to me so I can look over it and see what materials may have to be taken off. I am writing to you to speed up this process but have asked the same of my providers also.

Yours

After emailing Everard on a known working email address and giving it 5 days and getting no reply asking for the PDF file he supplied to my Website hosts alleging infringement of his copyright, we got no reply from him.

As it was alleged to our web hosts by Everard that areas of the site contained copyright items we needed to know what and where so we asked our hosts for a copy of the PDF file Everard had sent as he clearly refused to send it directly to us.

The Hosts kindly supplied the file to us (isn't it childish we had to get it through them not him, direct!?!) so we could see what his beef was. We were expecting just the pictures and screen-grabs were to blame. Well after viewing the PDF it was clear that he was had not in any way highlighted which areas of the PDF he was aggrieved with so we have to assume the entire content of the PDF file was showing Everards grievances. The PDF happened to contain nearly every page on this site, text and pictures. Text we had typed was also included.

So does this mean Everard was just 100% lazy in sending across a complete copy of our website and demanding it be removed, it its entirety. Should he have highlighted certain areas or is it more the case that he was yet again claiming that this entire site was HIS copyright. This may sound like a joke but if it were not for the FACT that he complained you youtube no less than 4 times that videos of me speaking to my webcam (no pictures of his, text or sound clips) were his copyright. This incident where he claimed copyright on something which clearly was not his has been documented on this site HERE:
http://www.christophereverard-conman.com/viewtopic.php?f=7&t=21

So is this how Everard always seems to do business - attack like a raging bull - with no etiquette and no thought to his actions being shown later on to be fraudulent or at the very least misguided and ill-thought out.

So you can see what the PDF contained we give you a link to it here - the file contained is offsite on CLOUD storage - download it to your hard drive and open it. Its a PDF it "should" be safe... but considering it was created by him... I did open it in a sandbox environment.

NOTE: THIS FILE IS HOSTED OFF THIS SITE AND SO IS NOT SUBJECT TO COPYRIGHT CLAIMS TO THIS WEBSITE HOST!

I am interested that in this PDF he chose to visit the site via a anonymity service called "Hide My Ass"... which is usually something that someone does when they have something to hide... like getting pirate movies, porn or wanting to hide ones presence. Why would he care that we knew he had been reading this website when he bundles it up as a complaint and posts it off to our hosts so we get to know about it anyway. Its like skulking around wearing a transparent face-mask. It makes no sense.

Finally this PDF shows that images such as those of Penelope Creighton Ward were included in his "copyright claim" and these images are from the Kids Tv series - "Thunderbirds" and are clearly not his to claim copyright on!
